ELECTRICITY EXPERT WITNESS SERVICES

ABOUT US

ELECTRICITY EXPERT WITNESS

Peter Sceats & Associates has the ability and experience to support external legal advisors or in-house legal teams of companies who find themselves involved in electricity related litigation. We act as an independent expert witness, fully conversant with the relevant passage of Cresswell J’s Judgement in the Ikarian Refer case.

As designers of various electricity trading businesses, trader of the world’s first standardised spark spread trade and procurement consultant to myriad consumers across Europe, we have a deep and unique understanding of international electricity pricing.

Very few other experts can cite trader (BHPB), supplier (RWE Group) AND broker (Tradition Group) experience, and no other expert witness can lay claim to the gravitas derived from being the founder of the benchmark that values all European coal power stations.

All expert witness work is carried out by our Principal Peter Sceats in person.

ELECTRICITY PANEL ARBITRATOR

We are commissioned regularly on a confidential basis to act as advisors and/or expert witnesses on international matters involving litigation both in the High Courts and also on arbitration panels.

ELECTRICITY LITIGATION SUPPORT

We help discover the underlying facts, understand trading patterns or relevant commercial activities and compare any given situation with usual practice of trade. We have substantial experience in establishing a fair and objective assessment of damages or 'quantum'.

The sums involved in complex litigation cases can be substantial, running into hundreds of millions of dollars. We provide expert testimony on such issues as pricing trends, valuation and current best practice on trading and contracts.

To keep costs down, our fees are structured into three simple bands:

  • •    A Rate - Charged only for appearance at court or arbitration
  • •    B Rate - Charged for most report drafting
  • •    C Rate - An associate rate charged for data collection and other general duties.

Recent examples of our work include:

  •    Litigation/Arbitration concerning supplier/consumer electricity billing
  •    Litigation/Arbitration concerning transfer pricing
  •    Litigation/Arbitration concerning electricity pricing linked to electricity (and other) indices
  •    Litigation/Arbitration concerning the valuation of electricity option value
